Hire Contract - Terms of Hire

1.  Definitions

 

1.1 The "HIRER" means the person/s, organisation or company booking the equipment, act or entertainment with the “COMPANY".  

 

1.2 The "COMPANY" means Stephanie Canham trading as Sorrel & Grace Events  

 

​1.3 The period of hire is from the agreed date of hire until the following day at an agreed time unless stated otherwise. 

 

1.4 This is written to comply with the English Contract Law 

2. Bookings 

 2.1 All equipment remains the property of the company at all times.

 

2.2 In the event of traffic or other uncontrollable circumstances preventing us from being able to fulfil our contracted obligations our liability shall be limited to a refund of any monies paid, other than the non- refundable deposit, in relation to the contracted event or a pro rata reduction in the hire fee in the event of delayed start. No further compensation will be paid. 

 

2.3 The final numbers & choices must be confirmed at least 14 days prior to the date of the booking. Any reductions in numbers after this time will still be charged for at the previous rate with no refunds given.

 

2.4 The hirer is responsible for providing Sorrel & Grace Events with all relevant medical/dietary information for all children attending the party. Sorrel & Grace Events will take no responsibility for allergies (including skin, food, material etc) where Sorrel & Grace Events were not advised of in advance.

3. Prices, Deposit & Balance Payments 

 

3.1 All hires are subject to a non-refundable deposit of at least £35.

 

3.2 The remaining balance to be paid in full and cleared one month prior to the event start date.

4. Location, Facilities & Conduct

 

4.1 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded. 

 

4.2 “THE COMPANY” reserves the right to refuse delivery if the venue or site is deemed to be unsuitable. In such a case no refund will be given and the full hire fee will be due.  

 

4.3 The hirer must ensure that the party area is clean and safe ready for the instillation of the equipment.

 

4.4 The hirer is responsible for ensuring adequate indoor space is available for the equipment to be set up and arranged. Sorrel & Grace Events will not refund in full or in part the monies paid in the event that adequate space is not available to set up the equipment which this hirer has confirmed on the booking form.

 

4.5 At no time will any level of abuse be tolerated towards Sorrel & Grace Events.

5. Liability & Insurance

 

5.1 “The HIRER” agrees to indemnify the company for any damage or theft of the COMPANY’s equipment whilst on hire.  

 

5.2 The COMPANY accepts no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.

 

5.3 No information on this booking form will be disclosed to any third party.

 

5.4 It is the responsibility of the hirer to inform guests accordingly of these terms and conditions.

 

5.5 Sorrel & Grace have suitable public liability insurance and take the upmost care to ensure the safety of all party guests at all times.

 

5.6 We use high quality products and follow strict hygiene routines.

6. Contract Terms & Conditions of Hire

 

If the hirer is in any doubt as to the meaning of the following, a representative from Sorrel & Grace Events should immediately be consulted before agreeing.

 

6.1 THE HIRER will, during the period of hiring, be responsible for the supervision of the equipment, its care, safety from damage however slight or change of any sort, and the behaviour of all persons of all ages using the equipment whatever their capacity, including proper supervision of children. Sorrel & Grace Events excludes any liability for injury loss or damage caused to any person using the equipment contrary to the terms and conditions of this Contract. 

 

 6.2 IN ALL HIRING CONTRACTS a refundable bond of £50 is payable with the remaining final balance. Such bond to be returned to the HIRER within 72 hours of return of the equipment, unless the hired equipment and any accessories have been damaged or lost during the period of hire and in such circumstances the bond will be used in full or part payment of those repairs/replacements. 

The HIRER shall indemnify Sorrel & Grace Events for the full cost of repair of any damage done to any equipment which may occur during the period of the hiring. 

 

6.3 THE HIRER shall not use the equipment for any purpose other than that described in the HIRING AGREEMENT and shall not sub hire or use the equipment or allow the equipment to be used for any unlawful purpose or in any unlawful way, nor allow anyone onto the equipment wearing shoes, carrying sharp objects, key-rings, metal studded clothing or any other similar items which could cause damage to others or the equipment. No food or drink is to be consumed on or in the equipment. The HIRER should not use the equipment outside.  

 

6.4 PUBLIC LIABILITY INSURANCE is excluded in its entirety following any claim or injury to any third party or employee whether directly or indirectly related to the use of drugs and/or alcohol.

 

6.5 IF THE HIRER wishes to cancel the booking for whatever reason, the following charges will apply.

 

• If cancelled less than one month before the commencement of the event date then 100% of the final balance is due to Sorrel & Grace Events. 

• If cancelled more than one month before the commencement of the event the deposit that has been paid to secure the booking is non-refundable.

 

6.6 Sorrel & Grace Events reserve the right to cancel the booking at any time for any reason but will endeavour to give as much notice as possible. Upon any such cancellation Sorrel & Grace Events will refund to the hirer any monies paid to us in respect of the booking but Sorrel & Grace Events will not be liable to pay any compensation to the hirer or any other person for any loss, damage or expenditure arising directly or indirectly from the cancellation.

 

6.7 Sorrel & Grace Events reserves the right to terminate the booking without notice if there is a breach of these conditions.
